A while back I wrote a post called Bang and Blame. It focused on whether some cases of rape are actually regret, you might want to go read it before continuing.
Since writing that, The Duke Lacross rape has been unmasked as a hoax and the ‘victim’ shown to be a liar, proving the notion in the earlier post that women don’t lie about rape to be false. Sure, there are still some loony lefties that claim she was raped, but most sane people see the lie for what it is. In the Duke case though, it wasn’t a lie because of regret, its motive is still unknown, maybe revenge for the argument at the party, maybe she hoped to collect money in a lawsuit, or maybe the rantings of a disturbed individual, we may never know. This is just one case, how many others are out there. A lot of real rapes may go unreported, how many fake ‘rapes’ are reported. The problem is that sometimes it is just his word against hers. Most people tend to believe her, using the ‘why would she lie’ theory. With most crimes that have little evidence and only two people with different takes on what happened, they usually don’t even prosecute, with ‘rape’, if they find the victim credible they do try to prosecute, even if the ‘rapist’ is also credible. A rape hoax like the Duke case hurts real rape victims, making them not want to come forward and have to go through all the hassle.

OOHH, OOHH or NO, NO?

OK, We’ve been talking about forced rape, grabbing an unwilling woman/man, throwing her/him down and fucking her while she/he screams or trys to push you away. There is also rape when they are drugged or passed out and you fuck them knowing they wouldn’t want to, and also holding a gun/knife/weapon to their head and fucking them. Of course as I pointed out in the last post, most guys wouldn’t claim rape.

So now we come to the reason for this post, when is rape a rape? It’s a strange question but bear with me. If a couple are making out, the guy slides his hand under her dress, if she says no and he continues against her continued protests, then clearly that is rape. If she let’s him continue, he puts his finger inside her and she starts protesting, again, continuing would be rape. Let’s say she didn’t protest, now they are hot and heavy into it, her panties are off, his underwear is off, lots of kissing and rubbing is going on, he reaches for the condom and she protests that she doesn’t want to go further, once again, continuing would be considered rape. All this is fairly clear so let’s muddy the waters some. She hasn’t said no, so with her guiding him in, he penetrates her and they start. So they are going at it and for whatever reason she decides she doesn’t want to continue. How far into the process can she say no? If he penetrates her and she starts protesting right away, then continuing could be considered rape. How about if they are halfway through? Or if he is about to climax? Or he has climaxed and is winding down? How much time does a guy have to stop before it’s considered rape? What if the woman is very vocal? if he can’t tell if she is yelling “oh oh” or “no no” does that factor into it?

You might think these questions are strange but they have come up. As stated in the article, the guy is in jail for five years, both the ‘victim’ and him agreed that the sex was consentual and that he pulled out after she wanted him to stop and before he climaxed. So why is he in jail? I don’t buy the idea that a guy can’t stop on a dime, like it says in the article, if a child walks in you can stop right away. What I don’t agree with is that in the heat of the moment, would a guy be able to understand that she truly wanted to stop? Moans, groans, oohhs and ahhs might cover a protest. The position the action is occuring in may also effect the hearing. How about the romantic music or the TV or the outside noise? How about the few glasses of wine that they drank before the sexual happenings began? Alcohol slows the reflexes and the brain reacts slower, not to mention that his blood has drained down into another appendage. So how long does a guy get to pull out? Does the timer start when she says no (even if he doesn’t hear it)? When he hears her say no? How many seconds does he get before he is a rapist?

Here is another article about the ‘rape’. In it she says she had just fucked his friend, she consented to have sex with him and he stopped ’5 or so seconds’ after she asked. I don’t think that is an unreasonable time. She said she didn’t feel like she could turn him down, why not, if she didn’t want to fuck him then say no, if he continued then that was rape. He stopped when she asked him to so I doubt he would have forced her if she said no. So what I would like to know is why she even brought the charges? If he didn’t force her, she agreed to fuck him, he pulled out when she asked, what is the problem? If a man comes up to you and asks if he can fuck you, even if he is large and even if you are afraid and even if you are in a scary part of town, most likely you would say NO, unless you did want to fuck him. If you say yes then you can’t say he raped you after the fact, he might not know you were afraid of him, he just figures he got lucky. Sure, you can say that if the same guy came up and asked for money from you you might give it to him because you are afraid of him, but sex isn’t the same as money, I might give the guy my money, but I would sure say NO to sex with him. If you gave the guy money, would he be arrested for robbery, that depends, but if he truly thought you were giving him the money then he shouldn’t go to jail. What if after you gave him the money you changed your mind and asked for it back and he gave it back, would he go to jail because he didn’t give it back fast enough if it took him ’5 or so seconds’? Sadly, sex isn’t something you can give back as easily.

So, I understand a woman not wanting to go beyond a certain point, fondling, touching and kissing may be fine, but she doesn’t want to go further. I can see her stopping a guy from continuing and considering it rape if he doesn’t. Once she has consented to let him penetrate her though, things change. He should still stop if she asks, but should it be considered rape if he doesn’t stop quickly enough? If they are fucking, then that is basically the final act of the play, so to speak, she has let him have her in every way. I can see if she is in pain she might want him to stop, but any other reason seems kind of pointless, she’s fucked him and any deniel would be regret. Claiming rape doesn’t change the fact. The first article mentions a woman wanting to stop because the guy wasn’t wearing a condom, shouldn’t she have noticed this earlier before the dick was inserted? And HIV is not something you mention you have while you are fucking someone so that’s not a good excuse either, but I’ll concede that it might happen rarely. So if the deed is done, and the guy isn’t forcing or hurting you and he stops when he hears you ask him too, why is a few seconds rape? Why would any woman call the police to report a rape in this case? I would wonder what happened and why. It doesn’t make sense to me.
